Lindsay Lohan will not appear in court on Monday to deal with a warrant for her arrest and will instead be represented by her lawyer.
Attorney Shawn Chapman Holley told The Associated Press on Sunday that she would show up in court on behalf of her 22-year-old client.
The warrant was issued on Friday by a Beverly Hills judge and carries a $50,000 bail. “The $50,000 warrant issued by the Beverly Hills Superior Court stems from a May 2007 arrest of Miss Lohan for DUI and hit-and-run,” read the Beverly Hills police statement, which was released on Saturday. Moreover, the statement explained that the facts that generated the “issuance of the warrant” were not immediately available and that police officials hoped Lindsay Lohan would turn herself in so as to work out the problem in due time.
However, Lindsay Lohan’s attorney said she considered the warrant had been issued because of a “misunderstanding” and that the matter should be clarified in court. A spokeswoman for the district attorney’s office nevertheless said that the warrant appeared to be related to the former child actress’ probation, as the “Mean Girls” star was sentenced to three years of probation after a couple of DUI arrests that took place in 2007.
Violations could comprise not completing a drug test or not reporting to the probation officer.
Lindsay Lohan was taken into police custody during Memorial Day weekend in 2007 after the Mercedes-Benz she was in hit a tree in Beverly Hills. The actress was arrested in Santa Monica weeks later following a 911 call made by the mother of Lohan’s former personal assistant. The woman wanted to report that her vehicle was being chased by a SUV driven by Lindsay Lohan.
Lohan pleaded guilty to two misdemeanor counts of being under the influence of cocaine, no contest to two counts of driving with a blood-alcohol level above .08 percent and one count of reckless driving. Nonetheless, she only spent 84 minutes behind bars and was requested to perform community service and submit herself to drug rehabilitation treatment. In addition, she was told that if she violated her probation she could face up to a year of imprisonment on each of the drunk-driving and cocaine charges, as well as 90 days on the reckless-driving charge.
Lindsay Lohan’s attorney claims her client has not violated the terms of her probation. She said during television program “Extra” last week that her client had met all of the court’s conditions and orders and that the warrant had been caused by a confusion “which I am confident I can clear up next week,” according to the show’s Web site.
Celebrity Web site TMZ.com cited unnamed sources as saying the actress was not complying with the terms of her probation and that reps of the actress’ alcohol education program informed the court on Friday about the repeated violations.
